Artists for Kamala: Benefit Auction 2024
In addition to Artsy’s General Terms and Conditions of Sale, the Harris Victory Fund Conditions of Sale apply to all Users that register and/or bid (“Bidders”). Where there is an inconsistency between the Artsy General Terms and Conditions of Sale and the Harris Victory Fund Conditions of Sale, the Harris Victory Fund Conditions of Sale will prevail. The Harris Victory Fund Conditions of Sale are as follows:
1.By participating in the auction, each Bidder certifies as follows: as this benefit supports a federal political committee, contributions must be from US citizens or lawfully admitted permanent residents (i.e. green card holders); contributions must come from your own funds, may not be provided to you by another person or entity for the purpose of making this contribution; you are making this contribution with your own personal credit card and not with a corporate or business credit card or a card issued to another person; you are at least 18 years old; and you are not a federal contractor.
2.Contributions will be used for political purposes. Contributions are not deductible as charitable contributions for federal income tax purposes.
3.You agree that the following information can be shared with and reported by the Harris Victory Fund and its participating committees in accordance with federal law: name, mailing address, occupation, and name of employer of individuals for any winning bid over $200.
4.You agree that following completion of Artsy’s Know-Your-Customer process, your winning bid will be subject to acceptance by the Harris Victory due to compliance with federal campaign finance contribution limits and laws.
5.The buyer assumes responsibility for additional fees which may include shipping, taxes, framing, and other additional fees. The Harris Victory Fund and Artsy are not responsible for the fees.
6.Additional Terms for certain artworks:
a. Resale Restriction for all artworks - Buyers shall agree that for five (5) years following the date that the buyer submits the Total Purchase Price for an Item (the “No Resale Period”), the buyer will not sell the Item.
b. Three Flags (swiped and moving) by artist Louise Lawler - The buyer affirms their identity may be shared with the artist and Sprüth Magers gallery.
c. Selection from Truisms: There are too few… by artist Jenny Holzer - The buyer shall agree that the No Resale Period for this Item is ten (10) years.
Contributions or gifts to Harris Victory Fund are not tax deductible.
Paid for by Harris Victory Fund, a joint fundraising committee authorized by Harris for President, the Democratic National Committee and the State Democratic Parties in these states: AK, AL, AR, AZ, CA, CO, CT, DC, DE, FL, GA, HI, IA, ID, IL, IN, KS, KY, LA, MA, MD, ME, MI, MN, MO, MS, MT, NC, ND, NE, NH, NJ, NM, NV, NY, OH, OK, OR, PA, RI, SC, SD, TN, TX, UT, VA, VT, WA, WI, WV, and WY.
The first $3,300/$5,000 from a person/multicandidate committee (“PAC”) will be allocated to Harris for President. The next $41,300/$15,000 from a person/PAC will be allocated to the DNC. The next $510,000/$255,000 from a person/PAC will be split equally among the Democratic state parties from these states: AK, AL, AR, AZ, CA, CO, CT, DC, DE, FL, GA, HI, IA, ID, IL, IN, KS, KY, LA, MA, MD, ME, MI, MN, MO, MS, MT, NC, ND, NE, NH, NJ, NM, NV, NY, OH, OK, OR, PA, RI, SC, SD, TN, TX, UT, VA, VT, WA, WI, WV, and WY. Any additional funds will be allocated to the DNC, subject to applicable contribution limits. A contributor may designate their contribution for a particular participant by contacting info@kamalaharris.com. The allocation formula above may change if following it would result in an excessive contribution. Contributions will be used in connection with federal elections, may be spent on any activity as each committee determines in its sole discretion, and will not be earmarked for any particular candidate. Federal law requires us to use our best efforts to collect and report the name, mailing address, occupation, and name of employer of individuals whose contributions exceed $200 per election cycle. Harris Victory Fund does not accept contributions from corporations or their PACs, unions, federal contractors, national banks, those registered as federal lobbyists or under FARA, SEC-named executives of fossil fuel companies, or foreign nationals.
